THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST UNLESS YOU ARE A LEGAL RESIDENT OF THE UNITED STATES, 18 YEARS OF AGE OR OLDER AND ARE LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.

The Petcentric Dog Show Photo Contest (the “Contest”) starts at noon CT on November 4, 2010 and ends at 11:59:59 a.m. CT on December 30, 2010 (the “Contest Period”). You may enter your photo in any of five categories: Best Expression, Best Athlete, Most Loveable, Best Troublemaker, Best John O’Hurley Look Alike. Each category winner will advance to the Best of Show “finals” round and will be judged with the other Category winners.

ELIGIBILITY: This Contest is offered and open only to legal residents of the United States, who are 21 years of age or older at the time of entry, who own a dog and who are registered members of Petcentric.com. Employees of Nestlé Purina PetCare Company, its subsidiary companies, affiliates, service providers, advertising and promotional agencies, and the independent judging organization, and the immediate family (spouse, parent, child, sibling and their respective spouses or "step" of each) and household members of such employees are not eligible. All federal, state and local laws and regulations apply to participation in the Contest. Void outside of the U.S.A. and where prohibited by law. Participation constitutes entrant’s full and unconditional agreement to these Official Contest Rules and Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: Enter by submitting a photo of your dog depicting the theme for one or more of the categories listed above. To submit your photo, access www.petcentric.com (“Website”) during the Contest Period to upload your photo, then complete an on-line entry form. You must complete all required fields on the entry form and then click "Submit”. Photos MUST be in .jpg or .gif format and cannot exceed 1 MB in filesize. Files not in this format will not be considered for the photo gallery or contest. Limit one entry per category per household; however you may enter the same photo in more than one category, as appropriate. Any attempt to submit multiple entries from one household in any category will result in all of the entries submitted being disqualified.

All entries must comply with the ENTRY REQUIREMENTS specified below and with the Sponsor’s Terms and Conditions for User Generated Content which can be found at: http://www.purina.com/general/TermsAndConditionsUserGeneratedContent.aspx. Any photo that does not comply with the ENTRY REQUIREMENTS or the Terms will not be eligible for entry into the Contest.

All entries must be received by 11:59:59 a.m. CT on December 30, 2010 to be eligible for consideration. No correspondence about entries will be entered into, nor will entries be acknowledged or returned. If all required information is not included, entry will be disqualified. Sponsor and or administrator will not acknowledge why an entry has been disqualified. Sponsor is not responsible for late or incomplete entries.

ENTRY REQUIREMENTS: Do not include any branded products, trademarks or logos in the photo, title or description. Each photo must only depict one dog – no humans or multiple dogs/pets. Photos must be the original work of the entrant; may not have won previous awards; may not have been published previously; must not infringe third-party rights; and must be suitable for public viewing, i.e., may not be obscene or indecent. Because Nestlé Purina PetCare Company promotes the compassionate care of all pets, photos and photo captions showing or describing unsafe situations or not exemplifying responsible pet ownership, in Sponsor’s sole discretion, will not be considered. The dog in the photo must be owned by the Entrant.

Entrant represents that he/she owns all rights to each element of his/her photo. Sponsor's determination as to whether the photo/caption potentially violates the rights of any third party is final.

Each Entrant irrevocably grants Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, display, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), Entrant's photo and title, and each element thereof, in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion), as well as to use Entrant's name, likeness, photograph (collectively, "Likeness"), and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor's use of any element of the entry, and agrees not to sue or assert any claim against the Sponsor for the use of any element of the photo, title or Entrant's Likeness or statements.

Entrant agrees to indemnify and hold Sponsor, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnitees due to or arising out of the use of any element of Entrant's participation in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement, violation of an individual’s right of publicity or right of privacy, or defamation. Entrant further agrees to release Sponsor and Indemnitees from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes Entrant's rights with regard to any elements or ideas contained in any element of the entry.

VOTING/JUDGING: During the Contest Period, entries will be posted on the Petcentric.com Website and members will be able to vote for their favorite entry in each category. Limit one vote per person per photo, per category. The use of automated voting methods is strictly prohibited and suspect votes will be disqualified. The public voting period begins at the beginning of the Contest Period and ends at 11:59:59 a.m. CT on December 30, 2010. Entries will also be judged by an independent judging organization whose decisions are final on all matters relating to the Contest. Public voting will count toward 40% of the total score assigned to each entry. The remaining 60% of the total score will be based on the score assigned by one or more independent judges using the following criteria:
Originality/Creativity: 25%, Fit with Theme: 50%, Composition: 25%

The entry in each category with the highest combined weighted score will be the Category winner. In the event of a tie, the Originality/Creativity score of the judges will be used to break the tie. All decisions of the judges and the Sponsor are final and binding in all matters relating to the Contest. Limit one Category prize per person or household. In the event that the same household/person receives the highest score in multiple categories, such person or household’s entry garnering the highest score would be declared the winner for the corresponding category and the next highest scoring entry in the other category would be declared the category winner for that category.

The category winners will advance to the final round of judging for the Best of Show Grand Prize, in which entries will be judged by a second panel of independent judges using the following criteria: Originality/Creativity: 50%, Composition: 50%. In the event of a tie, the category winner with the highest score in the first round will be declared the winner.

PRIZES: One (1) Category Prize in each of the Five categories: Each Category Winner will receive a Flip™ 4GB Camcorder Camera. Approximate retail value: $200/each.

One (1) Best of Show Grand Prize: Trip for winner and one guest to Aruba. Trip includes roundtrip coach class airfare for winner and guest from a major airport near winner’s home to Aruba, a 4 night all-inclusive stay for two at the Occidental Grand Aruba – nestled into the white powdery shores of Palm Beach. Occidental Grand Aruba includes meals, snacks, drinks, sports, SCUBA classes, snorkeling, nightly shows, live entertainment and tax and gratuity. Blackout dates may apply. Travel must be booked by 8/31/11 and completed by 12/31/11. Approximate retail value: $3,575. The value of may vary depending on point of departure, airfare fluctuations and time of trip. Winner is not entitled to any difference between the estimated approximate retail value and the actual value. Winner and guest must travel together. Guest of winner must be 18 years of age or older. All other costs of trip not specified herein, including but not limited to meals while traveling, airline baggage fees, ground transportation, and gratuities, are the sole responsibility of the winner. No prize substitution or cash redemption, except in the case of prize unavailability, in which case the Sponsor reserves the right to substitute a prize of equal or greater value. The total value of all prizes: $4,575.00.
In addition, a $5,000 donation will be made by Sponsor to an NPPC-approved shelter in the Best of Show Grand Prize winner’s community (shelter to be determined by Sponsor, not by the winner).

NOTIFICATION AND VERIFICATION: Winners are subject to verification by Sponsor or Administrator, whose decisions are final and binding in all matters related to the Contest. Grand Prize “Best of Show” Winner will be required to sign and return an Affidavit of Eligibility, Liability/Publicity Release and Assignment of Rights, in which he/she will irrevocably assign and transfer to the Sponsor any and all rights, title and interest in each element of the photo, title and description, including, without limitation, all copyrights, within 14 days of the receipt of the notification. Guest of winner must sign and return a liability/publicity release at least 30 days prior to trip departure. Failure to comply with these requirements may result in forfeiture of prize and the selection of another winner.

RELEASES AND GENERAL CONDITIONS: By entering the Contest, Entrants agree: (a) to be bound by these Official Contest Rules and the decisions of the Sponsor and Administrator, which shall be final and binding, and (b) that the Sponsor, its parent, subsidiary and affiliated companies, their respective officers, directors, agents, and employees are not responsible for and shall not be liable for: (1) any incorrect or inaccurate information associated with the Contest, whether caused by Website users, tampering, hacking, or any of the equipment or programming associated with or utilized in the Contest; (2) any errors, omissions, interruptions, deletions, defects, delays in operation, or unauthorized access to the Website or in any materials associated with the Contest; (3) any injury, damage, or loss to participants' or any other person's computer related to or resulting from participating in this Contest or downloading materials from, or otherwise using, the Website; (4) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (5) any design, typographical or other errors in any materials associated with the Contest; (6) garbled, incomplete, damaged, misdirected, late, lost, undelivered, or unprocessed entries; (7) any condition caused by events beyond the control of the Sponsor which may cause the Contest to be disrupted or corrupted; or (8) any loss, injury or damage of any kind caused by participation in this Contest, or by the acceptance and/or use of any prize. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend all or any portion of this Contest should fraud, virus, bugs, unauthorized human intervention, systems malfunctions, failures or difficulties, or other causes beyond the control of the Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of the Contest. All applicable federal, state and local taxes, are solely the responsibility of the winners.

Sponsor assumes no responsibility for any third party's failure to act in accordance with Sponsor's instructions pertaining to the implementation of this Contest.

By entering this Contest the entrant gives its consent for Sponsor to deliver entry material and personal information to the judges and/or other Contest administrators as required for the purpose of administering the Contest.
