NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST UNLESS YOU ARE A LEGAL RESIDENT OF THE UNITED STATES, 18 YEARS OF AGE OR OLDER AND ARE LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.
The Purina® 2012 Petcentric The Great Outdoors - Dog/Cat Photo Contest starts at 12:00:00 p.m. Central Time (“CT”) on March 30, 2012 and ends at 11:59:59 a.m. CT on April 30, 2012, (the “Contest Period”). The theme for the Contest is: The Great Outdoors! The assignment for the Contest is: The Great Outdoors! What’s so great about it? It’s a chance to spend time with your pet, soaking up the sun. Send us your photos of your dog or cat enjoying an outdoor adventure!
ELIGIBILITY: This Contest is offered and open only to legal residents of the 50 United States and D.C., who are 18 years of age or older at the time of entry (19 years of age or older in AL and NE), who own a cat or a dog. Any individual who has won a prize in connection with any photo contest offered on www.petcentric.com or via an application on the Petcentric page on Facebook during the previous 12 months or resides in the same household as any individual who has won a prize in connection with any photo contest offered on www.petcentric.com or via an application on the Petcentric page on Facebook during the previous 12 months, is not eligible to enter or win a prize. Employees of Nestlé Purina PetCare Company, its subsidiary companies, affiliates, service providers, advertising and promotional agencies, and the independent judging organization, and the immediate family (spouse, parent, child, sibling and their respective spouses or "step" of each) and household members of such employees are not eligible. All federal, state and local laws and regulations apply to participation in the Contest. Void outside of the 50 United States and D.C. and where prohibited by law. Participation constitutes entrant’s full and unconditional agreement to these Official Contest Rules and Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: Enter by submitting a photo of your dog(s) or cat(s) spending time in the “Great Outdoors.” To submit your photo, access www.petcentric.com (“Website”) or the Petcentric Photo Contest application on the Facebook platform during the Contest Period to upload your photo and complete an on-line entry form. You must choose to submit your entry in either the dog or cat segment. Complete all required fields on the entry form, including a title for the photo (up to 50 characters including spaces) and a description of the photo (up to 250 characters including spaces) and follow the instructions to upload your photo of either your dog(s) or your cat(s), then click "Submit”. To enter via the Website you must be a registered member of Petcentric.com. If you are not a registered member, click on “be a member” to join. You may include as many of your cats or dogs in the photo as you would like, however photos cannot include both cats and dogs and you must own each cat or dog in the photo. Photos MUST be in .jpg or .gif format and cannot exceed 1 MB in filesize. Files not in this format will not be considered for the photo gallery or Contest.
This Contest is in no way sponsored, endorsed, administered by, or associated with Facebook. You are providing your information to Sponsor and not to Facebook. Questions regarding this Contest should be directed to Sponsor at NestlePurinaConsumerServices@casupport.com, not to Facebook.
All entries must comply with the ENTRY REQUIREMENTS specified below and with the Sponsor’s Terms and Conditions for User Generated Content which can be found at: http://www.purina.com/general/TermsAndConditionsUserGeneratedContent.aspx. Any photo that does not comply with the ENTRY REQUIREMENTS or the Terms and Conditions for User Generated Content may be deleted or not be posted and will not be eligible for entry into the Contest.
All entries must be received by 11:59:59 a.m. CT on the last day of Contest Period to be eligible for consideration in the Contest. No correspondence about entries will be entered into, nor will entries be acknowledged or returned. If all required information is not included, entry will be disqualified. Sponsor and or administrator will not acknowledge why an entry has been disqualified. Sponsor is not responsible for late or incomplete entries.
ENTRY REQUIREMENTS: Do not include any branded products, trademarks or logos in the photo, title or description. Each photo must contain at least one dog or one cat, but photo cannot include both cats and dogs and no humans or other kinds of animals may be included in the photo. The Entrant must own each cat or dog in the photo. Photos must be the original work of the entrant; may not have won previous awards; may not have been published previously; must not infringe third-party rights; and must be suitable for public viewing, i.e., may not be obscene or indecent. Because Nestlé Purina PetCare Company promotes the compassionate care of all pets, photos and photo captions showing or describing unsafe situations or not exemplifying responsible pet ownership, in Sponsor’s sole discretion, will not be considered. Entries that do not comply with these requirements or any other requirements set forth in these Official Contest Rules, as determined by Sponsor in its sole discretion, will not be posted or, if posted, will be removed from the Website and the Petcentric Photo Contest application on Facebook.
If an Entrant’s photo is selected as a winner, the Entrant acknowledges and agrees that the Entrant will execute an Affidavit of Eligibility, Liability/Publicity Release and Assignment of Rights, in which he/she will irrevocably assign and transfer to the Sponsor any and all rights, title and interest in each element of the photo, title and description, including, without limitation, all copyrights, as a condition of receiving a prize.
Entrant represents that he/she owns all rights to each element of his/her photo. Sponsor's determination as to whether the photo/caption potentially violates the rights of any third party is final.
Each Entrant irrevocably grants Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, display, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), each element of the Entrant's photo, title and description, in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion), as well as to use Entrant's name, likeness, photograph (collectively, "Likeness"), and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor's use of any element of the entry, and agrees not to sue or assert any claim against the Sponsor for the use of any element of the photo, title, description or Entrant's Likeness or statements.
Entrant agrees to indemnify and hold Sponsor, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, as well as Facebook, Inc., and any of their employees (collectively, the "Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnitees due to or arising out of the use of any element of Entrant's participation in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement, violation of an individual’s right of publicity or right of privacy, or defamation. Entrant further agrees to release Sponsor from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes Entrant's rights with regard to any elements or ideas contained in any element of the entry.
VOTING/JUDGING: During the Contest Period, entries will be posted on the Website and the Petcentric Photo Contest application on Facebook and Petcentric.com members and fans of the Petcentric page on Facebook will be able to vote for their favorite entry in each category (dog and cat). Limit one vote per person per photo, during the Contest Period. The use of automated voting methods is strictly prohibited and suspect votes will be disqualified. Any attempt by entrant and/or his/her family/friend to vote more than the number of times authorized herein using multiple names or email addresses and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify entrant in its reasonable discretion. The public voting period begins at the beginning of the Contest Period and ends at 11:59:59 a.m. CT on the last day of the Contest Period. Within approximately ten days of the end of the Contest Period entries will be judged by an independent judging organization whose decisions are final on all matters relating to the Contest. Public voting will count toward 20% of the total score assigned to each entry. The remaining 80% of the total score will be based on the score assigned by one or more independent judges using the following judging criteria: Originality/Creativity (40%); Relevance to Theme (30%); and ability of entry to express the happy, healthy nature of your pet (30%).
The entry in each category (dog and cat) during the Contest Period with the highest combined weighted score will be the winner. In the event of a tie, the Creativity score of the judges will be used to break the tie. All decisions of the judges and the Sponsor are final and binding in all matters relating to the Contest. Limit one prize per person or household.
PRIZES:
Two First Prizes (one dog winner and one cat winner): Each winner will receive a Panasonic® FH25 Lumix® Camera, a Sony® DPF-D75 7” Digital Photo Frame and a Canon® Pixma iP100 Inkjet Photo Printer. Approximate Retail value of each prize: $530.00. Total ARV of all prizes: $1,060.00. All trademarks included under the prize section are trademarks or registered trademarks of their respective owners, which are not sponsors of or affiliated with this Contest in any way.
NOTIFICATION AND VERIFICATION: Winners are subject to verification by Sponsor or Administrator, whose decisions are final and binding in all matters related to the Contest. Winners will be notified by phone or mail following the winner selection.
RELEASES AND GENERAL CONDITIONS: By entering the Contest, Entrants agree: (a) to be bound by these Official Contest Rules and the decisions of the Sponsor and Administrator, which shall be final and binding, and (b) that the Sponsor, its parent, subsidiary and affiliated companies, and Facebook, Inc., and their respective officers, directors, agents, and employees are not responsible for and shall not be liable for: (1) any incorrect or inaccurate information associated with the Contest, whether caused by Website users, tampering, hacking, or any of the equipment or programming associated with or utilized in the Contest; (2) any errors, omissions, interruptions, deletions, defects, delays in operation, or unauthorized access to the Website or the Petcentric Photo Contest application on Facebook or in any materials associated with the Contest; (3) any injury, damage, or loss to participants' or any other person's computer related to or resulting from participating in this Contest or downloading materials from, or otherwise using, the Website or the Petcentric Photo Contest application on Facebook; (4) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (5) any design, typographical or other errors in any materials associated with the Contest; (6) garbled, incomplete, damaged, misdirected, late, lost, undelivered, or unprocessed entries; (7) any condition caused by events beyond the control of the Sponsor which may cause the Contest to be disrupted or corrupted; or (8) any loss, injury or damage of any kind caused by participation in this Contest, or by the acceptance and/or use of any prize. Sponsor may prohibit Entrant from participation in the Contest if Sponsor determines that Entrant has acted in a manner that affects the administration, security, fairness, or proper play or conduct of the Contest in any way. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend all or any portion of this Contest should fraud, virus, bugs, unauthorized human intervention, systems malfunctions, failures or difficulties, or other causes beyond the control of the Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of the Contest.
Sponsor assumes no responsibility for any third party's failure to act in accordance with Sponsor's instructions pertaining to the implementation of this Contest.
By entering this Contest the entrant gives its consent for Sponsor to deliver entry material and personal information to the judges and/or other Contest administrators as required for the purpose of administering the Contest. WHO WON: Winners will be posted at www.petcentric.com and the Petcentric page on Facebook by the 15th of the month following the Contest Period.
